ReLease Terms of Service

ReLease Coverage Company Inc. and its affiliates (ReLease, We) provide the ReLease website (the ReLease App) for use by you (You) for the purposes of utilizing ReLease financial technology to look for flexible rentals; signing up for notifications about flexible rentals; purchasing ReLease and/or third-party products; utilizing published ReLease reports; and other related services (collective, Services). ReLease provides you access to the Services and the App, subject to your acceptance of all of the following Terms and Conditions (Terms), which constitute a binding legal agreement between you and ReLease. By accessing, downloading, copying, and/or using a ReLease App, and/or the Services, you agree to be bound by the Terms.
You should also read ReLease’ separate Privacy Policy, which explains how ReLease handles and uses the data that ReLease collects when you use the App and Services, and which is incorporated by reference in the Terms. By agreeing to the Terms, you also consent to the collection and use of data as set forth in ReLease’s Privacy Policy.
- General Code of Conduct. Your use of the App and Services must follow this code of conduct:some text
- Don't use the App or Services in ways that break the Terms.
- Don't infringe on the intellectual property of ReLease.
- Avoid using the App or Services for spam, such as unsolicited ads, bulk emails/messages, or links to spam/phishing sites.
- Don't use the App or Services to spread harmful software like viruses, or to damage or illegally access any software, hardware, data, or personal information of ReLease or other users.
- Prohibited Behavior. You must not:some text
- Overload ReLease' infrastructure excessively.
- Disrupt the App or Services.
- Circumvent any access restrictions to the App or Services.
- Use tools to scrape or crawl any content on the App or Services.
- Collect or scrape content from the App or Services.
- Use the App or Services responsibly and follow all relevant laws.
- Accounts. To use many of the features of the App and Services, you must create an account and choose a strong password that meets any shown requirements. You're responsible for any issues caused by not logging out or leaving your account open. ReLease isn’t liable for losses or damages from your actions like not logging out or account misuse by others. We can close your account anytime for any reason.
- Data Protection and Privacy. In using the App and Services, you acknowledge and agree to ReLease' data protection and privacy practices as follows:some text
- Collection and Use. ReLease collects personal data necessary for service provision, including, but not limited to, your name, contact details, and transaction history. This data is utilized for facilitating access to the App and Services, processing transactions, and improving services.
- Security Measures. ReLease employs stringent security protocols to safeguard your personal data against unauthorized access, alteration, and destruction. These include advanced encryption techniques, strict access controls, and secure data storage.
- Legal Compliance. We adhere to applicable data protection laws and regulations. Your data is shared only when legally required or with your express consent.
- User Rights. You possess the right to access, rectify, or delete your personal data. Requests can be made through our designated contact channels.
- Policy Updates. Should there be changes to our privacy practices, we will inform you via registered contact methods or through notifications in the App and Services.
- Proprietary Rights. You acknowledge that:some text
- The App and Services are protected by intellectual property laws, owned by ReLease.
- Intellectual Property Rights include worldwide patents, copyrights, designs, trade secrets, trademarks, and legal protections.
- You won’t copy, modify, reverse engineer, or misuse the App and Services or its content. Don’t bypass security, or alter any proprietary notices.
- The layout, content, and code of the App and Services are ReLease’s property or licensed and cannot be used without permission. Unauthorized use may lead to legal action.
- This applies to third-party components in the App and Services, like computer code.
- Any improvements you suggest for the App and Services (“Feedback”) become ReLease’s property. You give up all rights and claims to Feedback and won't be compensated for it.
- Mentioning third-party products or services doesn’t mean ReLease endorses them.
- Interruption of Service. The App and Services may occasionally be offline briefly for maintenance or updates. We'll try to minimize downtime. ReLease isn't liable for any losses or damages from these interruptions.
- Termination of the App and Services, Your Access Thereto, and the Terms. ReLease can, at our discretion, block your IP, revoke your account, or terminate your access to the App and Services at any time without notice, if we believe you've violated the Terms. ReLease may stop providing the App and Services or parts of it at any time. We're not liable for any losses from this discontinuation. Terminating your access or the App and Services ends the Terms between us. However, sections like intellectual property, disclaimers, indemnity, and liability limits will still apply after termination.
- External Links. ReLease may link to third-party websites or services (Third-Party Resources) on the App and Services. Using these is at your risk, and governed by their terms. We provide these links for convenience and aren't responsible for your use of them. Review their terms and privacy policies. We don’t endorse their content, products, or services. - Any damages from using Third-Party Resources or their information.
- Malware received through these resources.
- Harm from using or relying on their content, products, or services.
- The actions of Third-Party Resource operators.
- Disclaimer of Warranties. Using the App and Services is solely at your risk. The App and Services and Third-Party Resources are "as is" and "as available". You're responsible for any computer damage or data loss from using the App and Services. ReLease isn't liable for any financial or other losses from using or downloading from the App and Services. While we strive for accuracy, information on the App and Services may change or contain errors. We're not liable for any losses due to these changes or errors. ReLease disclaims all warranties, including uninterrupted, error-free service, and absence of viruses. Some Platform content is third-party. We’re not responsible for this content, products, or services. If the law requires certain warranties, we provide only the minimum needed by law. We don’t guarantee:some text
- Secure, constant access to the App and Services.
- Error correction.
- Virus-free content or software.
- That the App and Services will meet your needs.
- Limitations of Liability. ReLease and our Representatives aren't liable for any losses or damages related to information on or downloaded from the App and Services, using the App and Services, or third-party materials on the App and Services. To the fullest extent allowed by law, ReLease will not be liable for any direct, indirect, or other damages (like lost profits or data, business interruption) related to using or not being able to use the App and Services, even if advised of the possibility of such damages. This applies to all legal claims.
- Indemnity. Despite any other terms in the Terms or any actions or inactions by ReLease, you agree to protect, defend, and compensate ReLease from any costs, liabilities, or legal fees resulting from:some text
- Your use of or connection to the App and Services and its information.
- Your activities related to the App and Services.
- Your breach of the Terms.
- Your infringement of third-party rights.
- Governing Laws and Jurisdiction. The Terms are governed by Ontario and applicable Canadian laws, excluding rules that would apply to other laws. Legal actions related to the Terms or the App and Services must be in Ontario's courts, to which you consent. ReLease can sue you in your jurisdiction for injunctions, judgments unenforceable in Ontario, or to enforce Ontario judgments. The United Nations Convention of Contracts for the International Sale of Goods doesn't apply to the Terms or disputes related to the App and Services.
- Miscellaneous Provisions. The Terms are your complete agreement with ReLease regarding the App and Services, replacing any previous agreements. If you have purchased a specified Service, you will also be bound by the specific terms and conditions of the Service you have purchased. ReLease isn't liable for not meeting obligations in the Terms due to uncontrollable events like mechanical or communication failures. If a court finds any Terms provision invalid, the rest remain effective. You agree that the court should try to preserve the intended effect of the invalid provision. ReLease's failure to enforce a provision in the Terms isn't a waiver of that provision. Section titles in the Terms are just for reference and have no legal effect.
